Welcome to CurtainSpace. These Terms of Service ("Terms") govern your access to and use of CurtainSpace's AI-powered curtain visualization service. By accessing or using our service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using CurtainSpace, you confirm that you:

2. Description of Service

CurtainSpace provides an AI-powered visualization tool that allows users to:

• Upload room photographs and fabric images
• Generate photorealistic curtain visualizations using artificial intelligence
• Manage a library of fabric samples
• Organize visualizations into projects
• Collaborate with team members
• Share visualizations with customers

3. Account Registration

To use CurtainSpace, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access
• Be responsible for all activities under your account

4. Subscription and Payment

4.1 Plans and Pricing

CurtainSpace offers various subscription plans with different features and usage limits. Current pricing is available on our website. We reserve the right to modify pricing with 30 days' notice.

4.2 Billing

• Subscriptions are billed in advance on a monthly or annual basis
• Payment is processed through Stripe, our secure payment provider
• You authorize us to charge your payment method for all applicable fees

4.3 Free Trial

New accounts may include a 14-day free trial. At the end of the trial, your subscription will begin unless you cancel beforehand.

4.4 Cancellation

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial billing periods

5. Acceptable Use

You agree not to use CurtainSpace to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Upload content that is illegal, harmful, or offensive
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Use automated systems to access the service without permission
• Resell or redistribute the service without authorization
• Upload images containing personally identifiable information of individuals without their consent

6. Intellectual Property

6.1 Your Content

You retain ownership of all images you upload and visualizations you create. By using our service, you grant us a limited license to process, store, and display your content as necessary to provide the service.

6.2 Our Service

CurtainSpace, including its software, design, and documentation, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of our service.

If you provide feedback or suggestions about our service, we may use this information without obligation to you.

7. AI-Generated Content

Our service uses artificial intelligence to generate visualizations. You understand that:

• AI-generated visualizations are approximations and may not perfectly represent real-world results
• We do not guarantee the accuracy of AI-generated content
• You are responsible for verifying visualizations meet your needs before relying on them

8. Privacy

Your use of CurtainSpace is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may:

• Perform scheduled maintenance with reasonable notice
• Modify or discontinue features with 30 days' notice
• Suspend service for violation of these Terms

10. Disclaimer of Warranties

CURTAINSPACE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURTAINSPACE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless CurtainSpace and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

13. Termination

We may terminate or suspend your account immediately if you violate these Terms. Upon termination:

• Your right to use the service ceases immediately
• We may delete your account data after a reasonable retention period
• Provisions that should survive termination will remain in effect

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.

16. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and CurtainSpace.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Failure to enforce any right does not waive that right.
• Assignment: You may not assign these Terms without our consent.
